Florida statutes require that you serve an NTO on EVERY job where you are not working directly with the owner (in contract with the owner) or where you are working as a subcontractor. A Florida NTO tells the owner that you are working on their construction project, and by sending the notice you have secured the right to lien the property in the case that you don’t get paid when the project is complete. If you wait until the project is complete or until you get the feeling that you may not get paid, you will most likely be out of time to serve your NTO. Florida law only allows 45 days from your FIRST day on the project to serve the Notice to Owner; if you go past this time without serving the NTO, you lose your right to lien the property.
