Public property cannot be liened. If you are working on a job that is public or private bonded project and you do not get paid, you can file a Notice of Nonpayment to make a claim against the bond. YOU HAVE 90 DAYS FROM YOUR LAST DAY OF WORK TO SERVE A NOTICE OF NONPAYMENT. If you are working as a subcontractor, you must file a Notice to Contractor within 45 days of your first day on the job in order to obtain the right to file a claim against the bond.

The charge for a Notice of Nonpayment is $95.00, plus USPS Certified Mailing fees. Typically a Notice of Nonpayment requires two Certified Mailings, one to the general contractor and one to the surety company.
