Affidavit of Hand Posting of a Notice to Owner

If you are very close to your time limit for serving your Notice to Owner and you are unable to hand deliver the NTO to the property owner, you can post the Notice to Owner at the job site to meet the 45-day time requirement. This form is needed if you are going to post your Notice to Owner at the job site. It is also recommended that you take a picture of the posted notice that includes a date and time stamp. Post your Notice to Owner at the job site as you would a Notice of Commencement, making sure that it is protected from the elements.

Use the Affidavit of Hand Posting form in addition to the photograph as proof that it was posted on the day that you claim.
